1. Eligibility

Our websites and services are intended for adults.

By purchasing or registering for an offering, you represent that you are at least 18 years old and legally able to enter into an agreement.

Certain programs or experiences may be designed specifically for women or for a defined audience. Eligibility requirements for a particular offering will be stated on the applicable registration or sales page.

2. Educational Purpose

Content provided by Fierce Impact Media and Dr. Diva Verdun is intended for educational, informational, and personal enrichment purposes.

Dr. Diva Verdun is a Master Teacher. Participation in a Fierce Impact Media or FENOM University experience does not create a therapist-client, physician-patient, attorney-client, financial-adviser, fiduciary, or other licensed professional relationship.

Our content is not a substitute for medical, psychological, legal, financial, tax, or other individualized professional advice.

You remain responsible for your own decisions, actions, and results.

3. No Guarantee of Results

We may share principles, distinctions, frameworks, examples, participant experiences, or other educational material.

Results vary from person to person.

We do not guarantee any particular personal, professional, financial, relationship, business, health, spiritual, or other result from using our content or participating in our programs.

Testimonials, examples, and participant experiences illustrate individual experiences and are not guarantees that another person will achieve the same result.

4. Registration and Payment

Registration and purchase requirements are stated on the applicable offer, registration, or checkout page.

Unless otherwise stated, payment is required according to the payment terms presented at purchase.

You agree to provide accurate billing and contact information and authorize us and our payment processors to charge the payment method you provide according to the terms of your purchase.

Any payment plan is a payment arrangement for the full purchase price unless the offer expressly states otherwise.

5. Product-Specific Terms

Different Fierce Impact Media offerings may have different:

• Delivery schedules
• Access periods
• Attendance requirements
• Refund or cancellation policies
• Payment terms
• Subscription terms
• Transfer policies
• Participation requirements

Those terms will be disclosed on the applicable sales page, registration page, order form, checkout page, or purchase agreement.

When product-specific terms conflict with these general Terms, the product-specific terms govern that purchase.

6. Live Events and Experiences

Some Fierce Impact Media experiences are delivered live online or in person.

Dates, times, attendance requirements, replay availability, and other logistics will be stated on the applicable offer.

A live experience advertised as having no replay will not include guaranteed access to a recording after the event.

Unless otherwise stated in the applicable purchase terms, registration applies only to the registered participant and may not be transferred without written permission.

We reserve the right to change reasonable logistical details when circumstances require.

7. Refunds and Cancellations

Refund and cancellation terms vary by offering.

The policy disclosed at the point of purchase governs that transaction.

Certain live experiences, digital products, memberships, intensives, private engagements, or other offerings may be nonrefundable when clearly disclosed before purchase.

If Fierce Impact Media cancels an event or program entirely and does not provide a reasonable substitute, transfer, credit, or rescheduled delivery, we will provide the remedy described in the applicable purchase terms or as otherwise required by law.

Failure to attend a live event or inability to access an online event because of circumstances on the participant's side does not automatically create a right to a refund.

Nothing in these Terms limits rights that cannot legally be waived.

8. Recurring Memberships and Subscriptions

Some offerings may be sold as recurring monthly or annual subscriptions.

When you enroll in a recurring subscription, the renewal frequency, price, and cancellation terms will be disclosed before purchase.

By completing the purchase, you authorize recurring charges according to those disclosed terms until the subscription is canceled.

Unless otherwise stated, cancellation prevents future renewal charges and becomes effective at the end of the current paid billing period.

You may cancel using the cancellation method provided with the applicable subscription or by contacting support@fierceimpact.com.

Cancellation does not ordinarily create a refund for a billing period that has already begun unless required by law or expressly stated otherwise.

9. Intellectual Property

Unless otherwise stated, all content provided through our websites, publications, programs, and services is owned by or licensed to Fierce Impact Media or Dr. Diva Verdun.

This includes, without limitation:

• Written content
• Videos and audio
• Presentations
• Books and publications
• Course and program materials
• Frameworks and methodologies
• Graphics and designs
• Worksheets and guides
• Trademarks
• Program names
• Logos
• Proprietary terminology

FENOM University™, Age With Power™, FIRE after 50™, Phoenix Ascension™, Architect of Ageless Power™, Identity Evolution™, and other identified names, marks, and frameworks are proprietary brand assets except where otherwise indicated.

Purchasing or accessing an offering gives you a limited, personal, nonexclusive, and nontransferable right to use the provided materials for your own personal purposes.

You may not reproduce, distribute, sell, publish, teach, sublicense, upload, record, commercially exploit, or create derivative commercial materials from our proprietary content without prior written authorization.

10. Recording and Distribution

Unless Fierce Impact Media expressly gives written permission, participants may not audio-record, video-record, photograph, screen-record, livestream, copy, or distribute protected portions of paid programs, live experiences, private sessions, or proprietary teaching materials.

Fierce Impact Media may record certain events or programs when participants have been appropriately notified.

Any use of participant image, voice, or testimonial for promotional purposes will be handled according to the consent provided for the applicable event or submission.

11. Participant Privacy and Confidentiality

Some programs, communities, or live experiences allow participants to share ideas, experiences, or personal information.

You agree to respect the privacy of other participants.

Do not reproduce, publish, identify, disclose, or commercially use another participant's personal story, confidential information, or contribution without that person's permission.

Fierce Impact Media cannot guarantee that every participant will comply with confidentiality expectations. Exercise discretion when deciding what to share.

12. Community and Participant Conduct

We are committed to maintaining respectful, productive environments.

We may restrict, suspend, or terminate participation when a person engages in conduct that materially disrupts an event or community, threatens or harasses another person, infringes intellectual-property rights, violates applicable policies, engages in unlawful activity, or materially interferes with our ability to provide the experience.

Any financial consequence of termination will be governed by the applicable purchase agreement, disclosed refund policy, and applicable law.

13. User Content and Testimonials

If you voluntarily submit comments, reviews, photographs, testimonials, or other content for publication, you represent that you have the right to provide that material.

We will obtain appropriate permission before using identifiable testimonials or participant content for marketing where consent is required.

Submitting information privately to us does not automatically grant us permission to publish it publicly.

14. Third-Party Services and Links

Our websites and services may use or link to third-party platforms, payment processors, video services, social networks, scheduling systems, websites, or applications.

We are not responsible for the availability, content, policies, or practices of third-party services we do not control.

Your use of those services may also be subject to their separate terms and privacy policies.

15. Website Availability and Technology

We work to maintain reliable websites and online experiences, but we do not guarantee uninterrupted or error-free access.

Internet outages, third-party platform failures, browser incompatibility, device problems, security incidents, or circumstances outside our reasonable control may affect access.

16. Disclaimer of Warranties

To the fullest extent permitted by law, our websites, content, and services are provided on an “as available” basis.

We make no guarantee that any website, event, program, product, or service will always be uninterrupted, error-free, or suitable for every individual purpose.

Nothing in this section excludes warranties or consumer protections that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Fierce Impact Media, Dr. Diva Verdun, and their contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our websites, content, or services.

Where liability cannot legally be excluded, liability will be limited to the extent permitted by applicable law.

Nothing in these Terms limits liability that applicable law prohibits us from limiting.

18. Changes to Services or Terms

We may modify our websites, programs, services, or these Terms from time to time.

The “Last Updated” date indicates the most recent revision.

Changes will apply prospectively unless otherwise required by law.

Material changes affecting an existing paid agreement will be handled according to that agreement and applicable law.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

21. Entire Agreement

These Terms, together with our Privacy Policy and any product-specific purchase terms, constitute the agreement governing your use or purchase of the applicable Fierce Impact Media service.
